Lands website privacy statement

The New South Wales Department of Lands (Lands) respects your privacy.

Users of the Lands website can expect that information obtained as a result of that access will be treated in accordance with the New South Wales Government's privacy practices as regulated by the New South Wales Privacy and Personal Information Protection Act 1998 and NSW Health Records Information Privacy Act 2002.

Submissions

If you choose to give us personal information via the Internet - in order for us to reply to you, process an order or provide you with information, for example - we we will advise you how we intend to use such information. We will not publish your name on this web site without your permission. We will not publish your e-mail address on this web site. We will not distribute this information to others except as reasonably incidental to the purpose for which the information is collected. For example, we will disclose your name and address to a company we use to deliver goods purchased through the site to you. If you tell us that you do not wish to receive additional information from us, we will respect your wishes.

Any and all information collected at this site, will be kept strictly confidential and will not be sold, reused, rented, leased, loaned, traded, or otherwise disclosed to a third party except where that disclosure is reasonably incidental to the purpose for which the information was collected (as explained above). Any information you give on this site will be held securely, and will not be used improperly.

Unsolicited information

By sending any unsolicited information or material to Lands, you grant Lands an unrestricted, irrevocable license to use, reproduce, display, perform, modify, transmit and distribute those materials or information, and you also agree that Lands is free to use any ideas, concepts, know-how or techniques that you send us for any purpose.

Collecting information

Some non-personal information about your IP address, web browser and computer operating system are automatically transmitted to our web servers as an integral part of the operation of the Internet. Some of this information is used for demographic purposes as a technical resource to help us better serve our web site visitors. We analyse this data for trends and statistics, and then we discard it.

Where information is downloaded from our website, or a business transaction is undertaken, further information will be retained as part of our web logs for audit purposes. 

Online transactions

If you place an order for products on this site, or use an online service that attracts a fee, we will collect information from you including:

  • the IP (Internet Protocol) address of the machine used to access the information
  • your top level internet domain name (eg .com, .gov, .au etc)
  • the address of your server
  • the date and time of your visit
  • the pages accessed and downloaded

If your online transaction involves the purchase of information, in addition to the information above, we will also keep a record of:

  • your credit card number and
  • contact information.

This information will be used to fulfil your order or to provide the relevant service and will be retained securely as part of our business records.

Online inquiries

If you make an online inquiry, the information you provide may be forwarded to staff within the Department who can assist with your questions.  The information will be used only to respond to the query made and a record of the communication will be retained for business purposes.
 
Statistical information, such as the number of inquiries and query response times, may also be aggregated from time to time for business purposes.  This information will be desensitised that is personal information will be removed to ensure the privacy of the inquirer is retained.

Mailing Lists

Should you subscribe to a mailing list your email address will only be used for the purpose for which it has been provided.

Subscription to a mailing list will require a confirmation of the subscription request – a double opt in.  If the request is not confirmed then no record of the information will be retained.

All emails from our mailing lists will provide you with an opportunity to cancel your subscription and have your email address removed from our records

Protection

Lands will use all reasonable endeavours to protect all personal information against loss, unauthorised access, use, modification, disclosure or other misuse.

Information may be provided to third parties Lands is legally required to do so.

Access to personal information

Lands will, at the request of an individual, provide the individual with access to all personal information which Lands holds and Lands will, at the request of the individual to whom the information relates, make appropriate corrections or additions to ensure that the information is accurate, relevant, up-to-date, and complete.

Public registers

Lands maintains several public registers in accordance with relevant legislation.  Generally, a fee is associated with access to and amendment of personal information held on public record.

By virtue of the Privacy and Personal Information Protection Regulation, 2005, certain registers maintained by Lands are exempt from the public register requirements of the  Privacy and Personal Information Protection Act, 1998.

Exceptions

Lands reserves the right to gather more extensive information than stated above and to make disclosures to appropriate authorities in circumstances where there:

  • appears to be unauthorised attempts to index, tamper with or otherwise interfere with files published on the site
  • appears to be unauthorised attempts to access files which are not published on the site
  • are attempts to intercept messages or otherwise interfere with the enjoyment of this site by other users;
  • are attempts to compromise the security of the web server or to breach the laws of New South Wales or the Commonwealth of Australia

This web site contains links to other web sites. Lands is not responsible for the privacy practices or the content of such web sites.

Review and update of the policy

This policy may be reviewed and modified from time to time due to the developing nature of online technologies and to reflect changes in policy, law and practice.
